A. Identification and domicile of the person resposible
Pursuant to the Federal Law on Protection of Personal Data Held by Individuals (hereinafter, the "LFPD") and the remaining applicable provisions, Bello, Gallardo, Bonequi y García, S. C. (hereinafter, the "Data Controller"), with registered office for service of process in Agustín Manuel Chávez, número 1-001, Centro de Ciudad de Santa Fe, Zipcode: 01210, Mexico City, hereby expressly informs you:
B. Personal Data Collected and Submitted to Processing
For the purposes pointed on this Privacy Notice, the Data Controller processes the following categories of personal data:
- Identification data;
- Personal data;
- Social data;
- Academic and prefessional data; and
- Work data.
The identified personal data categories can be collected by the Data Controller directly or personally from the owner; or indirectly through data transactions approved by the publication of your data on professional websites or social media.
As a candidate, you are responsible for communicating to people who you may register as references (either relatives or former employers) about the existence of the selection process in which you participate and the processing of personal contact details that you have provided for the purposes established in this Privacy Notice. You must inform them the means through which they can know consult entire content of this Notice, as applicable.
The acceptance of this Privacy Notice leads to the authorization that you, as a candidate for a job position, give to BGBG to contact the familiar and professional references that you may have provided, in order to obtain information and background about your performance in work environments.
C. Sensitive personal data processing
To comply with the purposes pointed out in the section below, the Data Controller will not gather sensitive personal data.
D. Processing purposes
a.) Original and necessary purposes
- Management, control, and administration of resumes and job applications received by the Data Controller for their assessment, contact with candidates, and personnel selection made by the Data Controller.
- Personal and/or work reference verification.
- When applicable, there will be non-binding job offers.
- Candidate statistics and historical record.
b.) Additional purposes
- There are none.
E. Personal data transfers
Your data may be transferred within the national territory or abroad to the following recipient categories and for the identified purposes:
- Parent companies, branch or subsidiary companies of the Data Controller; with assessment purposes as well as candidate profile analysis, information centralized safekeeping, and for statistical purposes and historical records of candidates of the Data Controller.
F. Data transfer consent
The data transfer refered to in the item above does not require your consent pursuant to the applicable regulation.
In all the other cases, your personal data will not be transferred to third parties without your consent, except on the cases set forth in LFPD, Article 37 and it will be done complying with the conditions set forth in LFPD, Article 17.
G. ARCO rights exercise
In all legally proceeding cases, you may exercise your rights to Access, Rectify, Cancel, and Oppose (ARCO) through the procedures that we have implemented.
The relevant request must fulfill all the requirements established in the current legislation, through a written notice addressed to our Personal Data Area, to the domicile indicated in this Notice, Item A.
The request must contain and be accompanied by the following:
- Your name and domicile or another mean to inform you the response to your request;
- The documents proving your identity or, when applicable, the legal representation;
- The clear and precise description of the ARCO Rights that you want to exercise; and
- Any other element or document that facilitates the localization of the personal data.
Alternatively, you may address your request to our Personal Data Area through the email address datospersonales@bgbg.mx, in compliance with all the requirements previously numbered, established as Subject of the communication "ARCO Rights and/or consent withdrawal". The procedure terms will be the same as the ones mentioned in this section. The use of electronic means for the exercise of ARCO Rights authorizes the Data Controller to respond to the relevant request through the same means unless the owner clearly and expressly points out another means.
You may obtain the requested information or personal data through uncertified copies, electronic documents in conventional formats (Word, PDF, etc.), or through any legitimate means guaranteeing and accrediting the effective exercise of the requested right.
The Data Controller wants to keep your personal data updated at all times. Consequently, we request your cooperation to communicate any change that we must consider to add it to our database. You guarantee and are in charge, in any case, of the veracity, accuracy, validity, and authenticity of the personal data provided for your personal attention or for that of any third party under your custody or legal representation.
H. Consent revocation
You may revoke your consent to your personal data processing without retroactive effects if such cancellation implies the impossibility of complying with the obligations derived from a legal relationship in force between you and the Data Controller; or if it represents the breach of the public general provisions establishing the obligation to maintain the personal data processing during a particular period.
The procedure for the revocation of consent will be the same as the procedure established in the section above for the exercise of ARCO rights, if applicable.
I. Limitations on the Use and Disclosure of your Personal Information
You may limit the use or disclosure of your personal data by addressing the relevant request to our Personal Data Area. The requirements for proving your identity, as well as the procedure for handling your request, will be the same requirements indicated in section "Exercise of ARCO rights".
The Data Controller has the means and procedures to ensure the inclusion of some of your data in its own exclusion lists when you expressly request their inclusion in them. The Data Controller will grant the relevant registration certificate to the registered owners.
J. Automatic means for collecting personal data
On our website www.bgbg.mx we use files known as "cookies" to facilitate navigation and communication through it. If you visit our website and/or send information through it, the cookies we use will allow us to gather, analyze, and retain technical information related to your browsing habits and the use of such communication channels. Cookies allow this information to be gathered automatically when the user makes use of our electronic services.

K. Amendments or Updates to this Comprehensive Privacy Notice
The Data Controller may modify, update, extend, or otherwise change the content and scope of this Privacy Notice at any time and at its complete discretion. In such cases, we will post those changes on the website www.bgbg.mx, Section "Privacy Notices". Changes to this Privacy Notice may also be communicated by email, when such means had been established as a channel of communication between you and Data Controller, during the term of any legal relationship.
